Terms and Conditions

I. DISCLAIMER. This Liability Release is applicable to all renters, operators, passengers, and users of boats and equipment provided by TL2 Inc. DBA Lux Hot Tub Boats. For purposes of this Liability Release, the term "Lux Hot Tub Boats" includes TL2 Inc., DBA Lux Hot Tub Boats, all employees, owners, officers, agents, representatives, servants, assigns, successors, insurers, and subsidiaries (collectively "Lux Hot Tub Boats"). This Liability Release covers all activities indirectly or directly associated with the use of Lux Hot Tub Boats' boats, equipment, facilities, marinas, hot tubs, services, and activities organized by, sponsored by, or directed by Lux Hot Tub Boats ("Lux Hot Tub Boats Activities"). Any dispute that may arise under or in connection with this Agreement, or related to any matter which is subject to this Agreement, shall be subject to the exclusive jurisdiction of the state and/or federal courts located in Seattle, WA.

II. ACKNOWLEDGMENT OF RISK. The undersigned understands and acknowledges that the Lux Hot Tub Boat Activities, hot tub activity, and boating activity, in general, involve inherent risks, as well as other foreseeable or unforeseeable factors or circumstances that may result in PROPERTY DAMAGE, BODILY INJURY, AND POSSIBLY DEATH.

III. ASSUMPTION OF RISK. By executing this Liability Release, the undersigned expressly assumes all risk that arises from the participation in Lux Hot Tub Boats Activities, the acts of others, the unavailability of emergency care, and any other foreseeable or unforeseeable factors or circumstances related to the Lux Hot Tub Boats Activities. The undersigned assumes all risk of injury, sickness, death, loss of or damage to property related in any way to the Lux Hot Tub Boat Activities, EVEN IF THE RISKS ARISE OUT OF THE NEGLIGENCE OR FAULT OF LUX HOT TUB BOATS.

IV. LIABILITY RELEASE. For good and valuable consideration of the use of Lux Hot Tub Boats' boat, equipment, or services, the undersigned, his/her heirs, executors, administrators, and assigns hereby expressly agree to indemnify, hold harmless, and release forever Lux Hot Tub Boats, including all employees, owners, officers, agents, contractors, successors, heirs, executors, administrators, volunteers, and their insurers, from any and all claims, demands, actions, causes of actions, suits in equity or whatever kind or nature, arising from this Agreement or use of the Lux Hot Tub Boat. Lux Hot Tub Boats shall not be liable for any damage arising from any property damage or personal injuries sustained by the undersigned, undersigned's guest(s), or any minor children under the undersigned's custody, care, and control, as a result of any and all activities, whether directly or indirectly related to the rental, operation, use of hot tubs, or use of boats or equipment provided by Lux Hot Tub Boats. The undersigned assumes full responsibility for any such injuries or damages that may occur, however caused, and further agrees that Lux Hot Tub Boats shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Lux Hot Tub Boats shall not be responsible for any injuries, damages, loss, or theft, however caused, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY LUX HOT TUB BOATS, whether such negligence is present at the signing of this Liability Release or takes place in the future.

V. LIABILITY TO THIRD PARTIES. The undersigned hereby agrees that he/she will indemnify and hold harmless Lux Hot Tub Boats from all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor child under the undersigned’s custody, care, and control, as a result of any and all activities, whether indirectly or directly related to the rental, operation, use of hot tub, or use of boat or equipment provided by Lux Hot Tub Boats, EVEN IF SUCH DAMAGES ARISE OUT OF THE NEGLIGENCE OR FAULT OF LUX HOT TUB BOATS.

VI. ACKNOWLEDGMENT OF WAIVER AND LIABILITY RELEASE. I ACKNOWLEDGE AND AGREE BY MY SIGNATURE BELOW THAT I HAVE READ AND AM AWARE OF THE TERMS AND CONDITIONS RELATING TO ANY LUX HOT TUB BOATS ACTIVITIES THAT I MAY UNDERTAKE. I HAVE HAD SUFFICIENT TIME TO REVIEW THE LIABILITY RELEASE AND TO ASK ANY QUESTIONS ASSOCIATED WITH SAID RELEASE. I HAVE CAREFULLY READ THE FOREGOING LIABILITY RELEASE, KNOW THE CONTENTS THEREOF, AND HAVE SIGNED THIS LIABILITY RELEASE AS MY OWN FREE ACT. I DECLARE THAT I AM IN GOOD PHYSICAL AND MENTAL CONDITION AND NOT SUFFERING FROM ANY MEDICAL CONDITIONS, INCLUDING, BUT NOT LIMITED TO, PREGNANCY, RECENT SURGERIES OR INJURIES WHICH MAY PRECLUDE ME FROM BOATING OR HOT TUB ACTIVITY.

 

Rental Rules 

  • Not permitted if temperature/fever or any other underlying symptoms of illness. 
  • The number of persons aboard this boat shall not exceed 6 (six) at anytime.
  • No swimming, bow riding, towing, or barbecuing from the boats. 
  • Renter is responsible for reading and observing, and causing all persons utilizing the boat to observe the Rules, Regulations and Procedures of Lake Union, and agrees to stay within the distance limitations as designated by Lux Hot Tub Boats. 
  • Boat will not be operated in a careless or unlawful manner, sub-rented, loaned, operated by a person who is under the influence of alcohol or drugs, or unfamiliar with its care and operation, or beached (other than in case of emergency).
  • Alcohol and drugs are prohibited on the boat at all times.
  • Pets are not allowed on the Hot Tub Boat. Service animals are allowed with proper documentation shown at time of rental. Emotional Support Animals are not allowed.
  • Renter shall not allow anyone under 21 years to operate the hot tub boat; anyone under 16 years must wear a life jacket (PFD) at all times. 
  • In the event of lightning, the boat must be returned to the dock immediately.
  • Renter shall immediately report any accident(s), malfunction(s), or breakdown(s) of the boat to Lux Hot Tub Boats staff.
  • All persons must remain inside the boat’s hot tub while the boat is moving, use caution and enter and exit the hot tub slowly. 
  • Limit soak to 15 minutes and cool off before re-entry; no jumping or diving into the hot tub.
  • Do not use oils or soaps while using the hot tub, glass is prohibited on the boat at all times 
  • Elderly persons, pregnant women, persons with heart disease, diabetes, high or low blood pressure or any serious illness, should consult with a doctor before use.
  • Lux Hot Tub Boats reserves the right to retake possession of said boat and equipment at any time without demand at Renter’s expense if the boat and/or equipment is used in violation of this agreement, any law or is apparently abandoned.
  • Renter is liable for any loss or damage to this boat and its accessories and any excessive cleaning necessary after use.
  • Renter is liable for any loss or damage to other vessels or persons resulting from the use or operation of this boat.
  • Renter agrees to a RENTAL FEE and a SECURITY DEPOSIT which will be applied to payment for any and all damage to the boat, its accessories and equipment occurring during the period of this Rental Agreement. Renter understands that he/she WILL REMAIN LIABLE.
  • Renter acknowledges that Lux Hot Tub Boats is not responsible for any lost or stolen items left behind during the rental. 
  • If the boat is returned more than 15 minutes late, renter is subject to a $100 surcharge. Adding $100 incrementally every additional 15 minutes.
